1. Acceptance of Terms
By accessing or using Path2Commit (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service. Path2Commit is operated by Path2Commit, LLC ("we," "us," or "our").
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Service Description & Eligibility
Path2Commit is an athlete recruitment platform designed to help student athletes manage their college sports recruiting process, including school matching, coach communications, profile management, and social media coordination.
Age requirement: You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent. We do not knowingly collect personal information from children under 13; if we learn we have done so, we will delete that information promptly.
NCAA/NAIA disclaimer: Path2Commit is an independent service and is not affiliated with, endorsed by, or approved by the NCAA, NAIA, NJCAA, or any other collegiate athletic organization. Nothing in the Service constitutes legal or compliance advice regarding recruiting rules. Users are solely responsible for compliance with all applicable recruiting rules and regulations.
3. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
You may not share your account with others or create accounts for the purpose of circumventing usage restrictions or subscription limits.
4. Acceptable Use & Prohibited Activities
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulation
- Harass, threaten, or harm any person through the Service
- Upload, post, or transmit any content that is defamatory, obscene, fraudulent, or infringes any third-party rights
- Attempt to gain unauthorized access to any portion of the Service or its related systems
- Interfere with the proper working of the Service, including by transmitting viruses or malicious code
- Scrape, crawl, or use automated means to access the Service without our express written permission
- Use the Service to send unsolicited communications (spam)
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Violate any NCAA, NAIA, or other applicable recruiting compliance rules
5. User Content License
You retain ownership of content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant Path2Commit a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of operating and promoting the Service.
You represent and warrant that you have all rights necessary to grant this license, and that your User Content does not violate any third-party rights or applicable law.
6. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Path2Commit, LLC and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial recruiting purposes in accordance with these Terms.
7. Third-Party Integrations
The Service integrates with third-party services including Google (Gmail), Instagram, and Twitter/X. Your use of these integrations is subject to the respective third-party terms of service and privacy policies. We are not responsible for the actions, content, or privacy practices of any third-party services.
Connecting a third-party account grants Path2Commit access to certain data from that account solely to provide the integration features you request (e.g., sending emails via Gmail, posting to social media). We do not sell this data.
8. DMCA Notice & Takedown
If you believe that content on the Service infringes your copyright, please send a notice to our designated DMCA agent:

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and its location; (3) your contact information; (4) a statement of good-faith belief that the use is not authorized; (5) a statement that the information is accurate; and (6) your physical or electronic signature.
9. Indemnification
You agree to defend, indemnify, and hold harmless Path2Commit, LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right; or (d) any claim that your User Content caused damage to a third party.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATH2COMMIT, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Mandatory Arbitration
Please read this section carefully. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except as otherwise provided herein.
Informal resolution first: Before initiating arbitration, you agree to first contact us at legal@path2commit.com and attempt to resolve the dispute informally for at least 60 days.
Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@path2commit.com with the subject "Arbitration Opt-Out." Opting out does not affect any other provision of these Terms.
Claims involving intellectual property rights or unauthorized access to the Service may still be brought in court.
13. Class Action Waiver
YOU AND PATH2COMMIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this waiver is found to be void or unenforceable, any class action shall proceed in federal court, not in arbitration.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL TO THE EXTENT PERMITTED BY APPLICABLE LAW.
14. No Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations.
15. Termination
We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases.
The following sections survive termination: Sections 5 (User Content License), 6 (Intellectual Property), 9 (Indemnification), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Mandatory Arbitration), 13 (Class Action Waiver), and 16 (Governing Law).
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Texas.
Any claim arising under these Terms must be brought within one (1) year after the cause of action arises, or such claim is permanently barred.
